This Privacy Policy describes how the Affiliate of SHRM (“Chapter,” “State Council,” “our,” “us,” or “we”) collects, uses, or discloses personal information we receive through our website and any other online or offline events, programs or services we provide (collectively, the “Services”). This policy also describes your choices about the collection and use of your information. Note that a SHRM “Affiliate” as used here does not mean the entity is a legal affiliate of SHRM.

Please read this policy carefully before you start to use our Services. By using the Services, you agree to be bound and abide by this policy and our posted Terms of Use (the “Terms”). If you do not agree to the Terms and Privacy Policy, or if you violate either of them, you may not use the Services. PLEASE SEE SECTIONS 10-12 OF OUR TERMS REGARDING YOUR LEGAL RIGHTS IN ANY DISPUTE INVOLVING OUR SERVICES, INCLUDING MANDATORY ARBITRATION AND A WAIVER OF RIGHTS TO A JURY TRIAL OR CLASS ACTION.

1.     How We Collect Information

We may collect information about you through various means, including:

 

  • Directly from you, both online (e.g., website, email) and offline (e.g., events, phone)
  • Through your use of our websites or related online services.
  • From SHRM, or from other Local SHRM chapters, SHRM forums, Staffing Management Chapters, Chapter and State Councils and other such organizations (collectively, “SHRM-Associated Organizations”).
  • From other third-party sources and social media platforms that you may use to engage with us.

2.     Types of Information We Collect

In order to provide you with our Services, we may collect the following categories of information:

 

  •  Profile information, such as name, address, phone number, email address, company, title, as well as billing, payment, and other business information.
  •  Survey information in response to questions we may send you, including for inquiries, feedback, and research purposes.
  • User Content you may provide for public use at events, on our website or in other aspects of the Services (e.g., presentation materials and recordings from our events, articles and publications, social media content, and other materials) along with any information you provide about yourself and the content—this may also include metadata associated with your content (such as location and date/time information embedded in pictures).
  • System logs such as your account settings and use of our Services.
  • Communications between you and us, such as via email, mail, phone, or other channels.
  • Offline activity you directly engage with us, if any.
  • Online activity described in the next section.

If you provide us with information regarding another individual, you represent that you are authorized to provide that person’s information to us for our use in accordance with this policy.

3.     Online Activity, Cookies and Information Collected by Other Automatic Means

Cookies are a commonly used web technology that allows websites to store and retrieve certain information on a user’s system, and track user’s online activities. We, together with the vendors we use, may collect information about your use of our Services by such automated means, including but not limited to cookies, pixels and other similar technologies.

 

Cookies and similar technologies can help us automatically identify you when you return to our website. Cookies help us review traffic patterns, improve the website, and determine what Services are popular. We can also use such information to deliver customized content and advertising to users of the Services whose behavior indicates that they are interested in a particular area.

 

When you use the Services, the information we may collect by automated means include, for example:

 

  • Usage details about your interaction with our Services (such as date, time, and length of visits, and specific pages or content accessed during the visits, search terms, frequency of the visits, referring website addresses);
  • Device information, including the IP address and other details of a device that you use to connect with our Services (such as device type and unique device identifier, operating system, browser type, mobile network information, and the device’s telephone number); and
  • Location information, where you choose to provide the website with access to information about your device’s location.

 

We may also engage advertisers or other partners to serve ads or services to you, which may use cookies or similar technologies placed by us or third parties. If a user does not want information collected through the use of cookies, most browsers allow the visitor to reject cookies, but if you choose to decline cookies, you may not be able to fully experience the interactive features our Services provide. We may share non-personal information we obtained via cookies with our advertisers and affiliates. Because there is not yet a consensus on how companies should respond to browser-based do-not-track (“DNT”) mechanisms, we do not respond to browser-based DNT signals at this time.

 

4.     How We Use Information We Collect

 

We may use the information we obtain about you for purposes allowed by applicable laws, including to:

 

  • Provide our Services to you, including managing your interactions with us, facilitating purchases and other transactions with us.
  • To deliver events and programming relevant to HR and related topics of interests.
  • Respond to your requests, questions, and comments.
  • Tailor the content we display to you in our Services and communications, offer services that we believe may be of interest to you, and for marketing and promotional purposes.
  • Operate, evaluate, and improve our activities, our website, and the services we offer.
  • Establish and maintain any account you create for our Services.
  • Analyze and enhance our communications and strategies.
  • Inform you about changes to this Privacy Policy and our Terms of Use and other policies.
  • Comply with and enforce, as needed, applicable legal requirements, industry standards, our policies, and our contractual rights.
  • Monitor the performance of our Services, including metrics such as total number of visitors, traffic, and demographic patterns.
  • Diagnose or fix technology problems.

 

We may also use or share information in an anonymized or aggregate manner for many purposes, such as research, analysis, modeling, marketing, and advertising, as well as improvement of our Services.

We may allow third parties to advertise their products or services through our Services. Advertisements may be sent to all our members or targeted to individuals who fit a certain general profile category, which may be inferred from the information we have about you.

5.     How We Share Your Information

We will not disclose your personal information to third parties without your consent, except in the following circumstances:

  • We may share your information with SHRM or other SHRM-Associated Organizations in our reasonable discretion (e.g., membership status, contact information).
  • We may also share your contact information with organizations we partner with for various purposes in our reasonable discretion—for example, we may share the contact information of event attendees with organizations that sponsored that event.
  • Limited information (e.g., IP address, pageview, etc.) may be collected through third-party online tools such as cookies, as described above. As explained above, you can take certain steps to prevent such collection.
  • We may share your personal information with our affiliates under common control and service providers that we believe need the information to perform a technology, business, or other professional function for us (examples include IT services, maintenance and hosting of our Services, payment processors, marketing partners, and other service providers), but we only provide such vendors with information so they can perform their required functions on our behalf.
  • We may disclose information about you (i) if we are required to do so by law or legal process, (ii) when we believe disclosure is necessary to prevent harm or financial loss, (iii) in connection with an investigation or suspected or actual fraudulent or illegal activity, or (iv) under exigent circumstances to protect the personal safety of our staff, members, or the public.
  • We reserve the right to transfer the information we maintain in the event we sell or transfer all or a portion of our organization or assets, provided that if we engage in such a sale or transfer, we will make reasonable efforts to direct the recipient to use your personal information in a manner that is consistent with this policy.

6.      Your Privacy Choices

We offer you certain choices about what information we collect from you, how we use and disclose the information, and how we communicate with you.

  • Marketing Emails: From time to time, we may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. You may choose not to receive marketing emails from us by clicking on the unsubscribe link in the marketing emails you receive from us. Even if you opt out of receiving such communications, we will continue sending you non-marketing email communications, such as business communications or administrative notices, when appropriate.
  • Cookies: Web browsers may offer users the ability to disable certain cookies; however, if cookies are disabled, some features or functionality of our Services may not function correctly.
  • Targeted Advertising: We may potentially work with advertising partners who collect information about your online activities and provide you with choices regarding the use of your browsing behavior for purposes of targeted advertising.
  • Membership: You may terminate your membership or potentially transfer to another suitable SHRM-Associated Organization. We may retain any account information or User Content for internal purposes and as provided in this Privacy Policy and our Terms.

7.     State-Specific Notices

Certain privacy laws may provide additional rights with respect to the collection and use of personal information collected by businesses: (i) disclose personal information maintained about the individual; (ii) correct or delete personal information maintained about the individual (subject to certain exceptions); (iii) not sell personal information about the individual about the individual to a third party (excluding qualified service providers); and (iv) not engage in third party targeted advertising. We do not engage in impactful profiling activities with respect to a user’s personal information, do not use sensitive personal information except for the reasons provided, and do not generally provide a financial incentive in return for the collection or use of personal information (except where disclosed with relevant terms at the time of collection). It can be unlawful to discriminate against an individual for exercising such rights. Due to our size and operations, we are generally not subject to any particular state’s privacy laws, but you can submit such requests to us via the contact information provided below, and we will endeavor to fulfill any obligations that are legally required; otherwise, we will respond to such requests in our discretion.

8.     Relationship with SHRM and other SHRM-Associated Organizations

SHRM-Associated Organizations may be authorized to use the SHRM brand and coordinate with SHRM, but they are legally and operationally independent from SHRM. This Privacy Policy does not apply to your personal information to the extent it is under the control of SHRM or another SHRM-Associated Organization. This may include your SHRM application and membership, and activities involving SHRM. If you are a member of SHRM and/or another SHRM-Associated Organization, you may be subject to their separate privacy policies and other terms governing your relationship with them.

As an SHRM-Associated Organization, we may be subject to certain data sharing arrangements with SHRM or other SHRM-Associated Organizations (e.g., membership status, contact information). In addition, as noted above, we may voluntarily share certain of your information with them, and likewise, they may share certain of your information with us.

9.     Links to Other Websites and Third-Party Content

Our Services may contain links to other websites or online services, including social media. Please be aware that we are not responsible for the content or privacy practices of such other websites or online services, and we encourage you to be aware when you leave our Services and to read the privacy statements of any other website or online service that collects personal information.

10.     How We Protect Information

We endeavor to maintain reasonable administrative, technical and physical safeguards designed to protect the personal information we maintain against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. However, we cannot ensure the security of any information you transmit to us, or guarantee that this information will not be accessed, disclosed, altered, or destroyed. We will make any legally required disclosures in the event of any compromise of personal information. To the extent the law allows us to provide such notification via e-mail or conspicuous posting on the Services, you agree to accept notice in that form.

We will only retain personal information for as long as necessary to fulfill the purposes we collected it for, including for any business, legal, account or reporting requirements. To determine the appropriate retention period for such personal information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which process the information and whether we can achieve those purposes through other means, as well as all applicable legal requirements.

11.     Children

We do not knowingly collect personal information from children under the age of 13 on our online Services and will endeavor to promptly delete any information upon discovery.

12.     Updates to Our Privacy Policy

We may revise or update this policy at any time. We will post the updated version on our Services and indicate when it was most recently updated. Your continued use of our Services after the updated policy is posted constitutes acceptance of the change and an agreement to be bound by the updated policy.
