The First 48 Hours: What HR Needs to Decide About Internal Investigation
This session gives HR practitioners a practical framework for the six structural decisions that shape everything downstream: how to categorize the matter, define the scope, assemble the investigation team, preserve evidence, manage confidentiality, and identify reporting obligations at the outset.
Attendees will learn why some investigations fail before they begin, often because these early decisions were made by default rather than deliberately, and how to make those decisions in a disciplined and defensible way. The material is calibrated for HR practitioners and grounded in litigation-informed practice.
It addresses attorney-client privilege posture, limits on witness confidentiality directives, and the reporting-obligation triggers most often missed at intake. The session includes an anonymized composite scenario, walked through decision by decision, followed by Q&A.
Participants will leave with a first 48-hours checklist for their next real matter, guidance on when to escalate to counsel, and a clearer understanding of the intake-stage traps that most often surface later in litigation.
